David B. Higgins

Mr. Higgins limits his practice to complex civil litigation with an emphasis on construction litigation, insurance coverage litigation and ski area defense. He has tried cases in numerous state and federal courts and has handled appeals before the Colorado Court of Appeals, the Colorado Supreme Court and the Tenth Circuit Court of Appeals. He has also lectured on a variety of subjects, including trial tactics, construction law and practice, and ski area liability matters. He is rated AV by Martindale-Hubbell.




Stephen Hopkins

Mr. Hopkins concentrates his practice in civil litigation, with emphasis on the defense of claims regarding general casualty, construction defects, ski area liability, attorney malpractice, contract negotiation and commercial litigation. Mr. Hopkins is designated AV by Martindale-Hubbell, the highest possible rating. He has taught and lectured in trial tactics, counseling and interviewing, and negotiation strategy at the University of Denver College of Law.




David McLain

David M. McLain is a founding member of Higgins, Hopkins, McLain & Roswell, LLC, a firm which specializes in construction defect and general civil litigation throughout Colorado. Mr. McLain received his undergraduate degree from Colorado State University, graduating cum laude, and his law degree from the University of Denver College of Law. He has a general civil litigation practice with an emphasis on the defense of complex construction defect lawsuits on behalf of developers and general contractors. As a result of the experience gained by defending some of Colorado's largest residential construction defect lawsuits, Mr. McLain is sought out by developers, general contractors, and subcontractors to consult on risk avoidance and risk management strategies. Currently among his clients are several of the state's largest homebuilders, regional and custom builders, Fortune 500 companies, and numerous insurance carriers. Mr. McLain is a regular speaker at seminars regarding construction defect litigation in Colorado. In addition, he is proud to serve as an instructor for the Home Builders Association of Metropolitan Denver's Quality Construction Certification program.




Sheri H. Roswell

Ms. Roswell is a founding member of Higgins, Hopkins, McLain & Roswell, LLC. For the past fifteen years Ms. Roswell's practice has focused on the defense of a complex construction defect lawsuits on behalf of developers, general contractors and other construction professionals. Ms. Roswell's practice also frequently includes providing consulting and risk management services to clients in both residential and commercial construction matters. Ms. Roswell's clientele includes a variety of construction professionals, from Fortune 400 companies to single contractor entities.
Ms. Roswell received her undergraduate education at the University of Colorado, School of Business in Boulder, Colorado and her Juris Doctorate from the University of Denver, College of Law. Ms. Roswell speaks locally and nationally on topics pertinent to the construction industry; lecturing to attorneys, construction professionals, and insurance organizations.




W. Berkeley Mann, Jr.

Mr. Mann is Special Counsel to the firm, and concentrates his practice in the areas of general liability, construction litigation, commercial litigation, and complex litigation in related areas of insurance law. Mr. Mann is designated AV by Martindale-Hubbell. He has handled cases involving complex construction issues, civil rights and employment claims, workers compensation defense, complex banking and commercial litigation, as well as the defense of catastrophic injury claims. He has taught for the Continuing Legal Education office of the Colorado Bar Association as well as for the Colorado Defense Lawyers Association.



 


William A. McLain

Mr. McLain limits his practice to property taxation matters before county assessors, county boards of equalization, boards of county commissioners, the Colorado Board of Assessment Appeals, the Colorado Division of Property Taxation, Colorado District Courts, the Colorado Court of Appeals and the Colorado Supreme Court. He also represents clients on property tax issues before the Colorado General Assembly. He is rated AV by Martindale-Hubbell.



 

Alex M. Nelson

Mr. Nelson's practice focuses on representation of construction professionals in a wide variety of both litigated and non-litigated matters. He has represented developers, general contractors, subcontractors, material providers, and heavy equipment owners and lessors. He has successfully litigated many construction defect, and other contract and commercial disputes in Colorado's state and federal courts, including at trial through jury verdict. He has also made extensive use of alternative dispute resolution, arbitrating and mediating many disputes to conclusion. He is experienced in preparing and negotiating contracts for many aspects of development and construction projects, including land purchase, prime construction contracts, subcontracts, and equipment leases. He has handled mechanics lien matters for his clients, has successfully secured insurance coverage for his clients in various construction disputes, and also consults on insurance and general risk management issues.




Bret Cogdill

Mr. Cogdill concentrates his practice in civil construction defect litigation. Since joining Higgins, Hopkins, McLain and Roswell in 2005, Mr. Cogdill has represented developers and general contractors in several cases involving large, multi-family developments. He has defended against allegations regarding all phases of development, from initial design to construction and finish work to incorporation of homeowners associations. He has also represented developers and construction professionals in cases related to single family homes, damages to underground utilities, and personal injury allegedly resulting from construction or design defects. Mr. Cogdill has negotiated several settlements between our clients and plaintiff-homeowners and recovered damages against subcontractors.




Derek J. Lindenschmidt

Mr. Lindenschmidt's practice focuses on representation of construction professionals in a wide variety of both litigated and non-litigated matters, including the defense of developers and general contractors in complex construction defect lawsuits. He has defended against claims in all phases of development, from initial design through post-construction, and has successfully recovered from subcontractors in subrogation. He has negotiated several settlements between our clients, plaintiff-homeowners and subcontractors. Prior to joining the firm, Mr. Lindenschmidt was an associate attorney with the Qualey & Beck Law Firm in Charleston, South Carolina, where he represented general contractors, developers, subcontractors and homeowners in various types of construction-related matters, including residential construction defect disputes, contract review and drafting, and defense of mechanics liens.




Shawn A. Eady

Mr. Eady joined Higgins, Hopkins, McLain & Roswell, LLC in January of 2008. Mr. Eady received his undergraduate degree from Colorado State University, and his law degree from the University of Denver College of Law. Prior to practicing law, Mr. Eady was the Contracts Administrator for the Construction Practice Group at one of the largest insurance brokers in Colorado where he advised general contractors, construction professionals, owners, developers, and subcontractors regarding insurance coverage, risk transfer, and risk management issues.
